By accepting a proposal, scheduling service, approving work by email, text, phone, online form, payment, or allowing Range Roots to begin work, the Client agrees to the following Terms and Conditions. These Terms and Conditions are incorporated into every estimate, proposal, service agreement, seasonal care plan, invoice, and approved service provided by Range Roots.

For purposes of this document, “Range Roots,” “we,” “our,” and “us” refer to Range Roots and its owners, employees, contractors, representatives, and agents. “Client,” “customer,” “you,” and “your” refer to the person, property owner, property manager, tenant, HOA, business, or authorized representative requesting or approving the work.

1. Scope of Services

Range Roots provides science based care for Colorado lawns, native grass areas, prairie style landscapes, soil health, turf recovery, garden beds, drought stress support, weed management, pest and disease diagnostics, and related green space services.

Services may include, but are not limited to:

Lawn care programs

Native grass and prairie care

Turf health and recovery

Soil health applications

Soil testing and interpretation

Garden bed care

Weed management

Disease and pest diagnostics

Drought and stress support

Cultural care recommendations

Irrigation consulting and visual irrigation observations

Seasonal multi visit care plans

Colorado green space management

Unless specifically stated in writing, Range Roots does not provide mowing, routine landscape maintenance, tree pruning, tree removals, construction services, irrigation installation, hardscape installation, snow removal, or guaranteed landscape establishment.

2. Agreement and Proposal Acceptance

A proposal becomes an agreement when the Client approves the work verbally, electronically, in writing, through payment, or by allowing Range Roots to begin service.

The proposal describes the general scope of work, estimated pricing, service area, timing, and any known limitations. If there is a conflict between the proposal and these Terms and Conditions, the proposal will control only for the specific service details listed in that proposal.

All agreements are governed by the laws of the State of Colorado.

3. Authority to Approve Work

The Client represents that they own the property or have full authority from the property owner, HOA, landlord, tenant, business, or responsible party to approve the work.

The Client is responsible for obtaining any required permission from landlords, HOAs, property managers, tenants, neighbors, or other parties before service begins. If the Client authorizes work on property they do not own or control, the Client agrees to protect, defend, and hold Range Roots harmless from any claim, cost, conflict, or damage related to that authorization.

4. Estimates, Property Information, and Measured Areas

Pricing may be based on lot size, estimated square footage, property conditions, access, service type, program level, product use, and information provided by the Client.

If the actual treated area, site condition, weed pressure, access difficulty, slope, irrigation condition, soil issue, or service need is materially different from what was provided or observed during estimating, Range Roots may adjust the proposal, recommend a revised plan, or decline to perform work that is outside the approved scope.

Online estimates are preliminary unless confirmed after inspection. Final pricing may change after the first inspection or service visit.

5. Seasonal Care Plans

Seasonal care plans are designed around repeated visits during the growing season. The exact timing of visits may change due to weather, soil moisture, pest pressure, disease pressure, product availability, plant growth stage, irrigation condition, or other site specific factors.

A care plan is not a guarantee of perfect turf, complete weed control, permanent disease prevention, seed establishment, full color, or total recovery. Lawns, native grasses, prairie areas, and landscapes are living systems affected by weather, soil, irrigation, traffic, animals, prior care, compaction, construction, drainage, cultivar, sunlight, and Client maintenance between visits.

Range Roots will make professional recommendations based on the information available at the time of service.

6. Application Timing and Weather

Applications may be delayed, rescheduled, modified, or skipped when conditions are not appropriate. This may include high winds, heavy rain, snow, freezing temperatures, excessive heat, drought stress, saturated soils, irrigation issues, poor access, unsafe conditions, or label restrictions.

Range Roots may adjust products, rates, timing, or recommendations when conditions require a more appropriate treatment. If a service cannot be completed safely or effectively, we may reschedule or recommend an alternative.

7. Pesticide, Herbicide, Fertilizer, and Soil Care Applications

Range Roots will apply products according to applicable laws, label directions, safety requirements, and professional judgment.

The term “pesticide” may include herbicides, insecticides, fungicides, miticides, growth regulators, biopesticides, and other regulated products. Natural, organic, biological, low toxicity, or soil health focused products may still require proper handling, restrictions, timing, and label compliance.

The Client agrees to keep people, children, pets, livestock, and sensitive individuals away from treated areas until the product has dried, the posted notice period has passed, or Range Roots provides other instructions.

The Client is responsible for notifying Range Roots before service of any sensitive areas, including edible gardens, vegetable beds, fruiting plants, beehives, ponds, water features, drainageways, wells, livestock areas, pet areas, school or childcare areas, pesticide sensitive persons, known allergies, or chemical sensitivity concerns.

8. Pesticide Notification and Posting

When required, Range Roots will provide pesticide application notices and place required signs at the time of application. Signs must remain in place for the required period and should not be removed early by the Client, tenants, guests, children, landscapers, or other parties.

The Client agrees to follow all post application instructions provided by Range Roots, including reentry, irrigation, mowing, pet access, and harvest restrictions where applicable.

9. Watering, Irrigation, and Cultural Care

Many lawn and landscape services depend on proper watering, mowing height, traffic reduction, soil moisture, and follow up care. Range Roots is not responsible for poor results caused by improper irrigation, broken sprinklers, drought restrictions, overwatering, underwatering, poor drainage, low mowing, scalping, pet damage, excessive foot traffic, construction damage, or failure to follow recommendations.

Irrigation consulting, irrigation audits, and watering recommendations are visual and advisory unless a separate irrigation repair or installation agreement is provided. Range Roots does not guarantee the performance of irrigation systems and is not responsible for hidden irrigation defects, broken heads, coverage gaps, wiring issues, controller issues, pressure issues, leaks, or improper installation.

10. Soil Testing and Diagnostics

Soil testing, pest diagnostics, disease diagnostics, and site evaluations are based on visible symptoms, field observations, lab results when used, seasonal timing, and professional interpretation.

Because many lawn and landscape problems have overlapping causes, Range Roots cannot guarantee that every pest, disease, soil deficiency, irrigation issue, or stress factor will be identified in a single visit. Recommendations may change as new symptoms appear, lab results are received, or site conditions change.

Lab fees, sample collection, shipping, interpretation, and follow up consulting may be billed separately unless included in the proposal.

11. Native Grass, Prairie, and Conversion Areas

Native grass and prairie style areas often require multiple seasons of management. Weed pressure, bare soil, slow establishment, uneven germination, seasonal dormancy, and changing appearance are normal parts of prairie and native grass care.

Seeding, overseeding, conversion support, and native grass recovery are affected by soil preparation, precipitation, irrigation, seed species, wildlife, birds, rabbits, weeds, erosion, foot traffic, slope, and timing. Range Roots does not guarantee seed germination, full establishment, complete weed elimination, or a specific visual result unless expressly stated in writing.

12. Weed, Pest, and Disease Expectations

Weed, pest, and disease management is a process, not a one time cure. Some weeds, insects, fungi, and soil issues require repeated treatments, seasonal monitoring, cultural changes, or long term management.

Range Roots does not guarantee complete elimination of weeds, pests, disease, grubs, mites, insects, fungal pathogens, invasive grasses, bindweed, thistle, cheatgrass, broadleaf weeds, annual weeds, perennial weeds, or recurring soil related problems.

13. Access to Property

The Client agrees to provide safe and reasonable access to all areas included in the proposal. Gates must be unlocked, pets secured, vehicles moved when necessary, and work areas cleared of furniture, toys, hoses, tools, decorations, waste, and other obstacles.

If Range Roots arrives and cannot perform the service because of locked gates, loose pets, unsafe access, blocked areas, lack of required water access, or other preventable conditions, the Client may be charged a trip fee, minimum service fee, or the full scheduled service amount depending on the situation.

14. Pets, Children, and Personal Property

The Client is responsible for keeping pets, children, guests, tenants, and other people out of the work area during service and after applications until the area is safe for reentry.

Range Roots is not responsible for injury, exposure, tracking, staining, product transfer, or damage caused by people or animals entering treated or active work areas before they are released for use.

15. Pet Waste and Unsanitary Conditions

For health and safety reasons, excessive pet waste, trash, sharp objects, needles, hazardous materials, or unsanitary conditions must be corrected before service.

If Range Roots must avoid areas, delay work, clean up, or return later due to unsanitary conditions, additional fees may apply. Range Roots may refuse service if conditions are unsafe.

16. Subsurface Utilities, Irrigation, and Hidden Conditions

The Client is responsible for identifying and marking private utilities, irrigation lines, invisible dog fences, low voltage lighting, drain lines, shallow pipes, septic components, buried cables, valve boxes, sprinkler heads, and other hidden systems that may not be marked by public utility locating services.

Range Roots is not responsible for damage to unmarked, inaccurately marked, shallow, hidden, brittle, or improperly installed systems. If work requires digging, soil disturbance, aeration, probing, sampling, or equipment use, hidden conditions may increase risk.

17. Existing Property Conditions and Incidental Damage

Range Roots will use reasonable care while working on the property. However, lawn and landscape work may involve hoses, tanks, sprayers, spreaders, carts, hand tools, soil probes, aeration equipment, sampling tools, and foot traffic.

The Client acknowledges that minor tracking, turf marks, footprints, tire marks, hose marks, wet areas, temporary discoloration, soil disruption, product odor, residue, or incidental disturbance may occur during normal service.

Range Roots is not responsible for pre existing damage, weak turf, drought stressed turf, poorly rooted sod, compacted soils, brittle edging, unstable pavers, cracked concrete, shallow irrigation, poor drainage, animal damage, or damage caused by normal access and service conditions.

18. Client Responsibilities Before and After Service

The Client agrees to read and follow all service instructions, including watering, mowing, reentry, pet restrictions, irrigation timing, mowing delays, reseeding timing, product precautions, and recommended cultural care.

Failure to follow instructions may reduce results and may void any service adjustment, courtesy follow up, or warranty that would otherwise apply.

19. Service Adjustments and Courtesy Follow Ups

If the Client has a concern about a completed service, they must contact Range Roots within seven days of the service date unless a different timeframe is listed in the proposal.

Range Roots may inspect the site and, at its discretion, provide a courtesy follow up, recommendation, service adjustment, or quote for additional work. Courtesy follow ups are not guaranteed and do not create a warranty.

20. Cancellation, Rescheduling, and Changes

The Client may cancel or request changes in writing before service is routed, materials are prepared, or work begins.

Because seasonal services require scheduling, routing, product preparation, and staffing, cancellations or changes may be subject to fees.

Cancellations more than 24 hours before a scheduled visit may be rescheduled without charge.

Cancellations within 24 hours may be subject to a trip, routing, or administrative fee.

If Range Roots arrives and cannot perform the work due to access issues, locked gates, pets, unsafe conditions, blocked areas, or Client cancellation, the Client may be charged a minimum service fee or the full scheduled visit amount.

For prepaid seasonal plans and completed services are non refundable. Unused services may be refunded at Range Roots’ discretion, less discounts, administrative costs, materials purchased, and services already completed.

21. Payment Terms

Payment terms will be listed on the proposal or invoice.

Unless otherwise stated, payment is due upon completion of each service or upon receipt of invoice.

Clients may pay per service, pay by seasonal plan, or pay in full when offered. If a pay in full discount is offered, the discount applies only when the full seasonal amount is paid before the first service or by the deadline listed on the proposal.

Payment may be made online, by check, or by cash when approved in advance. Exact cash is preferred because Range Roots may not carry change. Checks may be accepted at the first appointment or by mail. Online payments may include a processing fee when allowed by law and disclosed before payment.

Past due balances may result in suspended service. Late balances may be subject to late fees, interest, collection costs, attorney fees, returned payment fees, and other costs allowed by law.

22. Returned Payments

Returned checks, failed ACH payments, chargebacks, or disputed payments may be subject to a returned payment fee and any additional bank, processing, collection, or administrative costs incurred by Range Roots.

23. Permits, HOA Rules, and Local Requirements

The Client is responsible for notifying Range Roots of HOA rules, community restrictions, municipal requirements, access limitations, parking restrictions, water restrictions, pesticide restrictions, landscape rules, or other property specific requirements.

If permits, approvals, or additional compliance steps are required, the Client is responsible for associated costs unless otherwise stated in writing.

24. Product Availability and Substitutions

Product availability may change due to supply issues, label changes, weather, regulation, manufacturer shortages, or professional judgment. Range Roots may substitute comparable products, adjust the program, or recommend revised service timing when necessary.

25. No Guarantee of Outcome

Range Roots provides professional lawn, prairie, turf, soil, and landscape care services based on field experience, science based recommendations, and site conditions observed at the time of service.

Because landscapes are living systems, Range Roots does not guarantee survival, recovery, color, density, weed free conditions, disease free conditions, pest free conditions, seed establishment, soil correction, drought recovery, or permanent improvement.

26. Limitation of Liability

To the fullest extent allowed by law, Range Roots’ liability for any claim related to a service shall be limited to the amount paid by the Client for the specific service giving rise to the claim.

Range Roots shall not be liable for indirect, incidental, special, consequential, or lost value damages, including loss of use, loss of landscape value, loss of plant material, loss of turf, loss of enjoyment, or costs associated with replacement work by others unless required by law.

27. Insurance and Licensing

Range Roots will maintain appropriate insurance and licensing for the services it provides as required by law. Proof of insurance or licensing may be provided upon request.

Pesticide applications will be performed under applicable Colorado licensing, supervision, label, and recordkeeping requirements.

28. Photos, Videos, and Media

Range Roots may take photos or videos of the property, lawn, landscape, symptoms, soil conditions, weeds, pests, disease issues, treatment areas, and completed work for documentation, training, education, marketing, quality control, and client communication.

Range Roots will not intentionally publish private personal information without permission. The Client grants Range Roots permission to use non sensitive property images for business purposes unless the Client requests otherwise in writing before service.

29. Force Majeure

Range Roots is not responsible for delays or failure to perform caused by events outside its reasonable control. This includes severe weather, fire, smoke, drought restrictions, road closures, illness, labor shortages, supplier delays, equipment failure, acts of government, emergency conditions, unsafe site conditions, natural disasters, or other circumstances beyond reasonable control.

30. Dispute Resolution

The Client agrees to contact Range Roots promptly with any concern so the issue can be reviewed in good faith.

If a dispute cannot be resolved informally, the parties agree to attempt mediation before filing a lawsuit unless emergency legal action is necessary. Any unresolved dispute shall be handled in a court of competent jurisdiction in Colorado.

31. Attorney Fees and Collection Costs

If legal action, mediation, arbitration, or collection activity is required to enforce payment or these Terms and Conditions, the prevailing party may recover reasonable attorney fees, court costs, collection costs, and related expenses to the extent allowed by law.

32. Severability

If any part of these Terms and Conditions is found to be invalid or unenforceable, the remaining terms will remain in effect.

33. Updates to Terms

Range Roots may update these Terms and Conditions from time to time. The version posted on the Range Roots website or provided with the proposal at the time of service will apply to that service unless otherwise required by law.

34. Contract

By accepting a proposal, scheduling service, submitting payment, or allowing Range Roots to perform work, the Client confirms that they have read, understood, and agreed to these Terms and Conditions.
