1. Agreement and application

These Terms and Conditions apply to the services provided by Range Roots ("Range Roots," "we," or "us") when incorporated into the customer’s accepted proposal, service plan, or written authorization. The accepted scope and these terms form the service agreement. A specific written provision in a signed proposal controls over conflicting general terms. Requesting an estimate, inspection, or preferred visit date does not authorize paid work. Nothing in these terms eliminates rights or protections that cannot legally be waived.

2. Description of services

Services may include soil and lawn care; tree and shrub health care; pest, disease, and weed management; pruning; tree removals; tree, shrub, perennial, and native planting; landscape maintenance; vegetation and wildfire mitigation; forest, pasture, and acreage care; ecological restoration and preservation; inventories; and arborist and ecological consulting. Only the services expressly identified in the accepted scope are included. Marketing descriptions and a preliminary conversation do not expand that scope.

3. Defined scope and service boundaries

The proposal or care plan identifies the work areas, trees or plant material, tasks, visits, materials, tests, documentation, cleanup, and important exclusions. Irrigation installation and repair, landscape design, hardscape construction, concealed-condition remediation, and unrelated work are excluded. Any additional work, including mowing or specialist equipment not specified in the scope, requires separate written agreement. Changes may affect price and scheduling.

4. Estimates and pricing

An estimate is based on the information reasonably available when it is prepared, including reported or estimated treatment area, terrain, access, and site condition. Prices may be revised before acceptance if those assumptions prove inaccurate. Once accepted, changes to the price for the agreed scope will be communicated and authorized before additional work proceeds, except for a safety-related pause or action necessary to prevent immediate harm.

5. Acceptance and permission to work

Customer authorizes Range Roots to enter and perform the agreed work on the identified property and represents that Customer owns the property or has sufficient authority to approve the work. Electronic acceptance, signature, or another mutually agreed written confirmation may constitute authorization. Work does not begin solely because an estimate is requested.

6. Property information and area verification

Customer will provide reasonably accurate property details, service-area boundaries, known landscape sensitivities, and relevant history of prior applications, planting, or soil work. Range Roots may confirm the actual treated area and may adjust a prospective proposal accordingly. Work in neighboring or disputed areas will not be performed without appropriate authorization.

7. Service recommendations and alternatives

Recommendations balance the customer’s objectives, site conditions, preservation, safety, and long-term land and plant health using current ecological knowledge and applicable industry practices. Pruning and tree care specifications use applicable ANSI A300 standards; arboricultural operations follow applicable safety requirements and ANSI Z133 practices. Timing, methods, or products may change with actual conditions, labels, or legal requirements. Material changes to the agreed cost or objectives require approval. Recommendations are professional judgments based on available information, not a promise of a particular biological outcome.

8. Seasonal care programs

A seasonal care program covers only the number and type of visits stated in its accepted plan. Visits are intended to follow biologically appropriate service windows and may not be evenly spaced. The program does not renew automatically unless the parties have expressly agreed to renewal terms. Work outside the listed season or beyond the listed visits requires separate authorization.

9. Scheduling, weather, and seasonal conditions

A date or time selected on an inquiry form is a preference until Range Roots confirms the appointment. A confirmed inspection is separate from authorization for production work; any assessment or consulting fee is agreed before the appointment. Weather, wind, temperature, soil moisture, access, biological treatment windows, restrictions, or safety conditions may require rescheduling. Range Roots will communicate material changes and arrange a reasonable alternate window. Online inquiries are not monitored as an emergency response service.

10. Service territory and access-related charges

Service availability depends on property location, route density, safe access, and the scope of the assignment. Any travel, mobilization, or unusual-access charges must be disclosed in the proposal or otherwise approved before they are incurred. Range Roots may decline or postpone a visit if site access creates an unreasonable safety risk.

11. Payment arrangements

Unless the accepted proposal states otherwise, payment is due according to the invoice or care plan. Accepted payment methods may include online payment, check, and cash. Customers may be offered the option of paying for an entire care program in advance or paying after each scheduled treatment, as specified in the plan. When cash is accepted at a visit, exact payment is preferred; check or mailed payment arrangements should be confirmed with Range Roots.

12. Advance-payment discount

A five percent (5%) discount may be offered when a qualifying full seasonal care plan is paid in full in advance. The discount applies only when stated in the accepted offer and does not automatically apply to one-time services, optional add-ons, taxes, or previously completed work. If an advance-paid plan is canceled, any refund or account reconciliation will reflect services already performed, committed nonreturnable materials if previously disclosed, and any discount that no longer applies, subject to applicable law.

13. Online payment and processing costs

Online invoices may be paid through the designated payment platform. Any payment-processing charge will be disclosed before payment and added only where legally permitted and properly presented. Range Roots does not ask customers to share payment-card numbers over ordinary email. Fees charged by a bank or a third-party payment provider are governed by that provider’s terms.

14. Unpaid invoices and billing questions

Customer should notify Range Roots promptly of a billing concern so the parties can review the scope and invoice. If an invoice remains unpaid, Range Roots may suspend future discretionary visits after reasonable notice, subject to applicable law and any written service commitment. Interest, collection costs, or late fees apply only if separately agreed in writing and legally permissible; this general copy does not establish an automatic late-fee rate.

15. Rescheduling, cancellation, and termination

Customer may request to reschedule or cancel upcoming work by contacting Range Roots as early as practical. Charges, if any, for special-order materials, nonrefundable outside costs, or work already completed must be specifically supported by the accepted agreement and applicable law. Range Roots may stop work for unsafe conditions, lack of authorization, or material nonpayment, with an appropriate accounting for work performed and amounts already paid. Any applicable statutory cancellation rights remain in effect, and required cancellation notices will be provided when applicable.

16. Access to the property

Customer is responsible for providing reasonable, safe access to the areas covered by the plan, including applicable gates, codes, parking, and permitted equipment routes. Locked gates, inaccessible areas, obstructions, or other restrictions may require the service to be rescheduled. Customer should identify any access limitations before the visit.

17. Children, pets, and other occupants

Customer will keep children, pets, and unauthorized individuals away from active work zones and comply with any posted or communicated safety and reentry restrictions. Range Roots may defer application or service if people or animals cannot be kept clear of the treatment or equipment area. Customer is responsible for informing tenants, guests, and other authorized occupants of site-specific instructions.

18. Hidden structures, underground utilities, and fragile features

Before soil cultivation, aeration, excavation, or comparable work, Customer must identify known private lines, shallow irrigation, lighting cable, buried edging, invisible fences, drains, and delicate or concealed landscape features that may not be marked by public utility-locating services. Range Roots will use reasonable care and required utility-location procedures for the approved scope; responsibilities for unknown conditions are determined by the facts, the agreement, and applicable law.

19. Watering and establishment care

Water availability and the customer’s watering practices materially affect plant establishment, soil treatments, and lawn performance. Range Roots does not provide irrigation installation or repair. The customer is responsible for arranging a suitable water source, maintaining any irrigation system, and following written watering and aftercare instructions. Report failures or unusual plant decline promptly so the care plan can be reviewed.

20. Site preparation and follow-up care

Customer will complete reasonable site preparation communicated in advance, which may include removing toys, furniture, pet waste, debris, and portable equipment from treatment areas. Customer is responsible for any aftercare specified in writing, such as watering, mowing delays, traffic restrictions, seed establishment, or temporary avoidance of a treated area. Outcomes may be reduced when aftercare is not completed.

21. Soil samples, testing, and interpretation

When purchased or included, testing may involve field measurements or a third-party laboratory. Laboratory fees and the specific analyses included will be stated in the scope. A sample reflects the conditions at the sampled location and time and may not represent every portion of a property. Results and recommendations are interpretive information, not a guarantee that one amendment or treatment will produce a particular result.

22. Inspections, diagnosis, and professional advice

Inspections and diagnosis are based on the defined assignment and the conditions visible or reasonably available at the time. Hidden defects, roots, pests, disease, changing weather, and site history may require further investigation, laboratory testing, or monitoring. Unless expressly included, a visit is not a complete tree inventory, formal tree risk assessment, forensic analysis, engineering review, or certification that a property is free of hazards. The proposal identifies any formal assessment level and written deliverables.

23. Pesticides, herbicides, and regulated applications

Any pesticide or herbicide use must conform to the product’s current label, applicable registration, and Colorado and federal requirements. Product selection, application timing, rates, and treated sites are subject to legal and label limitations. A proposed product may be replaced or omitted when conditions, regulations, or the label make its use inappropriate. Range Roots will provide required notices and application information in accordance with applicable rules.

24. Treatment exclusions and reentry directions

Certain plants, areas, edible crops, pollinator habitats, waterways, weather conditions, or site uses may require a treatment exclusion or alternate approach. Customer will identify sensitive areas before work and follow communicated label-required precautions, including any reentry or irrigation restrictions. Range Roots may refuse a requested application that it determines cannot be lawfully or safely performed.

25. Natural-minded care and integrated pest management

References to natural, ecological, or soil-focused care describe an approach to evaluating conditions and selecting appropriate management methods. They do not mean every service is pesticide-free, certified organic, or free of synthetic inputs. Any specific product restriction, organic certification requirement, or no-spray area must be stated in writing and accepted before the service.

26. Response times and environmental variation

Plant and soil systems respond over time and are affected by temperature, drought, moisture, plant age, compaction, fertility, pest pressure, and prior maintenance. Improvement may require multiple visits or seasons. Short-term appearance may differ from long-term plant health, and observations from one area may not predict response in another.

27. Weed, pest, and disease control limitations

Treatments are designed to manage identified concerns within the agreed scope, but complete eradication or permanent prevention of every weed, pest, or disease is not promised. New infestations, seed banks, pest movement, weather, and surrounding properties may influence results. Follow-up beyond the purchased plan is not included unless separately stated.

28. Turf, native grass, prairie, and garden-bed care

Care methods appropriate for conventional turf may not be suitable for native grasses, meadow or prairie plantings, or mixed garden beds. Services will be limited to the site types and management objectives identified in the proposal. Reseeding, establishment, transplant survival, invasive-species eradication, and restoration outcomes depend on conditions and ongoing stewardship and are not guaranteed unless a specific written warranty is provided.

29. Preexisting conditions and third-party work

Range Roots is not responsible for conditions or losses caused by preexisting disease, drought, improper planting, historic soil disturbance, prior pesticide use, neglected irrigation, wildlife, severe weather, or work by other contractors, except to the extent Range Roots’ own wrongful acts contribute to the damage. Customer should disclose known concerns and recent applications to help prevent incompatible treatments.

30. Damage, concerns, and remedies

Range Roots will use reasonable care in performing approved services. Customer should report a suspected service-related problem promptly, with relevant photos and the affected location, so it can be examined and addressed. Any remedy will be determined based on the work performed, causation, the parties’ written agreement, and applicable law. Nothing in this clause limits liability that cannot lawfully be limited.

31. Unforeseen conditions and additional work

Unexpected rock, debris, irrigation defects, hidden site conditions, hazardous material, severe pest pressure, or other conditions may change what is safe or feasible. Range Roots may pause work and present a revised approach. Except for an immediate safety measure, additional chargeable services must be approved before being performed.

32. Field notes, photographs, and use of images

Range Roots may record measurements, service notes, and photographs reasonably needed for estimating, treatment records, safety, quality control, and customer reporting. Identifiable property images will not be used in public marketing without Customer permission where such permission is required or has been agreed as a business practice. Customer remains responsible for obtaining any necessary permissions from tenants or other people depicted.

33. Communications and customer information

Customer agrees that Range Roots may use the contact information provided to communicate about estimates, scheduling, care instructions, invoices, safety issues, and service follow-up. Customer may request reasonable preferences for nonessential communications. Personal information should be handled according to applicable law and any separately published privacy notice; this agreement does not authorize the sale of customer information.

34. Questions, disputes, governing law, and changes

The parties will first try in good faith to resolve service or billing concerns through direct communication. This agreement is governed by applicable Colorado law, without overriding mandatory consumer protections. If a provision is unenforceable, the remaining provisions continue to apply to the extent lawful. Changes to an accepted service agreement require mutual agreement; Range Roots may publish updated general terms for future proposals but will not retroactively change an already accepted scope without Customer consent. 35. Tree pruning, removals, and cleanup

The accepted scope identifies the trees or shrubs, pruning objectives, removal limits, work methods, access, personnel and equipment needs, and debris handling. Required permits, permissions, property boundaries, and responsibilities for obtaining approvals are identified before work begins. Stump grinding, root removal, log retention, haul-away, planting, grading, and lawn repair are included only when stated. Tree preservation is considered where appropriate; removal of an agreed tree is irreversible. Range Roots may pause work when conditions differ materially or safe methods require a revised plan.

36. Tree and landscape planting

The planting scope specifies species or agreed selection criteria, sizes, quantities, nursery material, site preparation, installation, mulch, and any establishment visits. Material substitutions require approval. Existing stumps, buried obstructions, soil limitations, utilities, and access may require a revised scope. The customer completes the written watering and establishment care. Survival or replacement warranties apply only when expressly provided in writing, with their period, conditions, and remedy stated.

37. Forest, wildfire, and vegetation mitigation

Mitigation and forest work are limited to the vegetation, treatments, boundaries, debris handling, and maintenance identified in the proposal. Work is intended to manage agreed fuels or vegetation concerns while considering retained vegetation, access, soil condition, and site objectives. It cannot eliminate wildfire, tree failure, erosion, or other natural risk, and does not guarantee protection of a structure or acceptance by an insurer or government program. Official program assessments, approvals, and certifications remain with the relevant authority.

38. Ecological restoration and preservation

Restoration work is phased around the agreed objectives, existing resources, soil and vegetation conditions, feasible methods, and monitoring needs. Native establishment, invasive-plant control, habitat improvement, and recovery may require repeated visits and continuing stewardship. The scope identifies seed or plant materials, disturbance limits, monitoring, maintenance, and any measurable completion criteria. Natural establishment and ecological outcomes are not guaranteed unless a specific written commitment states the criteria and remedy.

39. Consulting reports and reliance

The consulting agreement identifies the purpose, site, assessment level or methods, deliverables, intended users, fee, and any follow-up. Reports reflect conditions and evidence available on the stated assessment date. Formal tree risk assessments, appraisals, inventories, mapping, and ecological reports are distinct assignments and are not automatically included in a work estimate. Recommendations require review when conditions or project plans change. Consulting does not include legal advice, engineering certification, or a regulatory determination unless separately performed by an appropriately authorized professional.
